Abstract
This chapter examines the National Cooperative Research and Production Act (NCRPA) - the 1993 successor to the National Cooperative Research Act (NCRA) of 1984 that reduced the potential antitrust liabilities for research joint ventures (RJVs). The chapter reviews the theory and evidence about RJVs and the NCRPA and then addresses the question of whether there is a need for the relatively new antitrust law embodied in the statute. The review explains the controversial possibility that the NCRPA provides unnecessary, and perhaps even too much, protection from antitrust litigation.
